Terms of Service The Terms of Service ("Terms") describes the services ("service" or "services") provided by Coin Pay AG through Wall of Coins ("us" or "we" or "our" or "WOC") to you as an individual or business ("you" or "your"). Your use of our services is subjected to the terms outlined below and are legally binding when using WOC. Definitions Seller – You are a seller if you list crypto for sale using our sell page. Buyer – You are a buyer if you set a buy hold for crypto using our buy page. Crypto – P2P internet commodity further described at http://www.bitcoin.org Who We Are / Who We Are Not We are a service that helps to connect holders of Crypto ("sellers") with holders of FIAT currencies ("buyers"). By putting a buyer hold on an order ("Order"), you agree to pay the described sum Payment into the provided bank account via cash deposit within 2 hours the same business day ("on time"). You agree the Crypto will not be used for illegal purposes. Unpaid orders are cleared regularly. If the cash deposit receipt is not received on time, the seller and WOC are no longer responsible for the release of any Crypto or the return of FIAT. If you miss being on time for your payment, you must contact WOC support to have the order re-opened. Having 3 or more unpaid buyer holds within a 72 hour time period will result in a ban from WOC. If you supply false information for the fulfillment of your order, you may be charged a $25 USD fee directly debited from your next Order. By putting a buyer hold on an order, you agree that you are not a resident of New York. If the cash deposit receipt is received on time, Crypto will be released to the buyer’s provided Crypto address within 24 hours, usually within 15 minutes. Wire transfers, electronic bank transfers, ACH transfers and any other payment method not listed as acceptable on WOC are strictly unauthorized and WOC and the seller will not be responsible for dispersal of Crypto if such payment methods are used. Payment Verification. Buyers may be required to submit a form of payment proof, subject to approval by WOC ("Payment Proof"). After Payment Proof is approved, the Buyer will receive their Order as described above unless the Seller is able to provide proof that the payment is missing or unacceptable, subject to approval by WOC ("Non-Payment Proof"). If Non-Payment Proof is accepted, the Buyer will not receive their Order until valid Payment Proof is received and the Order is subject to expiring or being canceled, which will be handled as described by these Terms of Service. Any suspicious holds, especially larger transactions, may be subject to government issued photo identification or any other information necessary to identify the Buyer. This is subject to WOC discretion. Failure to present identification upon request can result in Crypto funds not being released. If any fraudulent document is provided by buyers or sellers, we reserve the right to withhold funds until a valid document is provided. Any cash that is deposited BEFORE a hold is placed will be subject to being withheld, with no crypto being released. If proof of payment is uploaded within 15 minutes of your hold expiring or improper payment is made (e.g. Incorrect amount paid, unacceptable payment method, payment not made on time, etc.), an additional $10 USD plus 2% fee will be removed from the order. If proof of payment is uploaded within 24 hours of your hold expiring, an additional $20 USD plus 5% fee will be subtracted from the order. If the funds once in escrow are no-longer available after your hold expired or you canceled the order, you may have lost your payment and WOC can not be held liable. If proof of payment is supplied and the payment is found to have been reversed, refunded, or unavailable for the seller to pick up, a fee of $25 USD will apply at the discretion of WOC to the Order if the Order payment is under $2,000 USD and $50 USD if the Order payment is at or over $2,000 USD. Other fees that may incur under the following conditions, will be subtracted from the Order, and will be valued by WOC: * To change the remit address for any Order or Transfer: $25 USD if the Order or Transfer is valued under $2,000 USD and $50 USD if the Order or Transfer is valued at $2,000 USD or greater. * Secondary Escrow Service ("SES"): Orders may be placed in SES if the Order is unable to be fulfilled due to required information missing from the Order or buyer unable to supply information necessary for fulfilling the Order. Upon the Order's Crypto being moved to the SES, there will be a fee of $25 USD for Orders under $2,000 USD and $50 USD for Orders at or over $2,000 USD. For every calendar day that the Order's Crypto is in the SES, there will incur a fee equal to 0.56% of the original Order Crypto amount. * Unexpected Methods of Payment: should the Payment for an Order be found to be an Unapproved or Unexpected Method of Payment, such as personal checks, the Order could be held for as long as 60 calendar days and will incur a fee of $25 USD for Orders under $2,000 USD and $50 USD for Orders at or over $2,000 USD. * Unexpected Amount of Payment: should the Payment for an Order be under the original Payment amount that was required, the Order will incur a management fee of $25 USD for Orders under $2,000 USD and $50 USD for Orders at or over $2,000 USD. By placing a sell order, you agree that all Crypto payments sent to the escrow address provided by WOC may be sold. Once the Crypto payment is received into the escrow address, the sell order will be listed and available for buyers to view on WOC. By placing a sell order, you represent and agree that you are not a resident of New York. You may modify the price of your sell order, but it will not affect the price of any current buyer holds pending. You must modify the pricing of your sell order using the website selling portal. To cancel a sell order and remove your Crypto from the escrow address and back to your original address, you can do so within the Account Balances page found within the Selling Portal. You agree that any and all debts owed to Coin Pay AG, WOC, or any subsidiaries, may be withdrawn in the Crypto equivalent or USD equivalent of Crypto from any of your escrow accounts at the discretion of WOC. Should any payments from buyers be refused or denied by the seller, the buyer will receive their order in entirety. In this incidence, the seller will be warned ahead of time and have 24 hours to respond with a written notice providing evidence as to why the payment needed to be refused or denied ("Written Notice"). The Written Notice must be sent to the support email box provided by the WOC support team. Sellers will receive a response on whether the Written Notice is approved or denied. If the Written Notice is denied, the buyer will receive their order in entirety. If the Written Notice is approved, the seller will receive back 80% of the order amount held in escrow minus $100 USD for processing ("Written Notice Deposit"). The final amount of the Written Notice Deposit will be determined by WOC and sent directly to the funding address of the Order's Selling Account within 2-3 business days. Sellers are responsible for the good-standing of their selling accounts. When you close any of your banking accounts or payment-receiving accounts, you must disable all associated WOC Selling Accounts. Failure to do so may incur a fee of $25 USD at the discretion of Coin Pay AG for each order that has a returned payment or inability to pay the account. Sellers are responsible for following their own regulations in their own legal jurisdictions. WOC is not responsible for your adherence to financial regulations. Please be aware some jurisdictions have Know Your Customer laws for transactions greater than $1,000. WOC is not responsible for any holds, unauthorized charges or changes made to your bank account, such as a hold placed on your account by your banking institution. WOC is not responsible for unauthorized deposits into your account or payment reversals. Sellers must also confirm or deny payments through the WOC service within 3 hours upon request or WOC will not carry financial liability for processing fraudulent orders. Otherwise, the WOC Support Team has you covered! As long as the seller terms are adhered to, all processed payments are guaranteed. Privacy Policy This privacy policy has been compiled to better serve those who are concerned with how their 'Personally identifiable information' (PII) is being used online. PII, as used in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our website. What personal information do we collect from the people that visit our blog, website or app? When ordering or registering on our site, as appropriate, you may be asked to enter your name, email address, phone number, ID or other details to help you with your experience.
